If he had immediately shot the guy 5 times would he have been arrested?

Or is it just because he went BACK and shot him 5 more times?

I'm kind of torn. Definately not first degree murder, I mean he was the guy who was getting held up.

Though he already shot the guy in the face... why not just take the weapon away from him and tie up his hands and feet until the cops get there?
