Because they had no leverage because they screwed up when trying to use the tough guy act and "punish" him for saying the obvious. If they had just admitted that his lawyer had got them on sloppy work by the lab, given him the 15 days as reccomended by thier hearing officer, this would have been over and done with. But since they made the mind numbing decision to give him more days based upon ridiclous reasoning they made the situation into one where if Dutrow had pushed the case in court he would have almost assuredly won. This was a compromise. Dont underestimate the ability of any govt appointed board to be ignorant.

How Muillins fare in the NYRA detention barn fiasco...never heard another word about it...no penalty...no days... no harm no foul But..."Mullins didn't know he couldn't bring a syringe into the detention barn"

Different scenario because that was a NYRA rule as opposed to a medication/state rule. Mullins had no leverage but NYRA seemingly let him off the hook because they simply dont have the authority that a racing commission has. In this Dutrow case, the truth is that the state cut the deal to save face, not Dutrow. If it went to a court case, it would have been an embarrasment to the state of KY when the conduct of its board was shown to be in violation of the law. I am not saying that Dutrow is not guilty or doesnt deserve the time but pointing out the ineptitude of the KHRA's board in dealing with the issue.
