Bing Crosby, Foul is a Foul?

I may have missed a few threads, but Bordonaro was clearly hit in the face w/ the whip and broke his stride, I think he would have won that race. Was a little suprised they didn't change the finish. I know it was not on purpose, but a foul is a foul. Any thoughts?
