Any reference to the Kentucky Derby is owned by CDI. If they expect to use any footage, naming references, etc. in promotion, they will presumably need to broker a deal to do so. You can't reference the Super Bowl or anything related to it in advertising without expressed consent and permission from the NFL - this is no different.

Considering the fact that they haven't exactly endeared themselves to CDI, by calling them out on national TV...just saying....Would you put it past 'em?

The only two words they need are California and Chrome. It would be easy to use his name and likeness and work around any mention of the Derby.
