I get the fact that the NYSRWB is filled with a bunch of political hacks who know little about the sport that they regulate. Their inability to change the rule to allow supers in races with entries is a perfect example of their incompetence.
But with .50 pic-4s in at other tracks in NYS, I think it would take little effort or time by NYRA to get such a change through. (It's not a rule-making issue that would be subject to the State Administrative Procedure Act.) Every year come Saratoga, there's some tweak to the wagering menu/rules that has been allowed in relatively short order. Whatever the shortcomings of the NYSRWB are, this one does fall on NYRA (assuming that they have not asked for such a change).
