The franchise extension in 1983 had a provision that stated the land would be ceded to the state if NYRA ceased to run the franchise, and I have stated earlier this is the legal claim the state has on the land and very much the issue to be ruled on, but there is a substantial argument against the legality of this provision.
That same language was also NOT in the franchise extension from 1997.
