Talk about bizarre. Here is Mac's statement from after RH's maiden win:
“The goal was to get him to run as a 2-year-old so he has a chance to win the GI Kentucky Derby,” McIngvale explained. “Because you have to run as a 2-year-old to have a chance to win the Kentucky Derby. So we got it in right there at the wire. And he gave us all some excitement and some humor yesterday. And we thought it was great.” http://www.thoroughbreddailynews.com...hared-archive/ |

It all hinges on what can be substantiated on what their agreement was, doesn't it. In the absence of proof of their agreement, she would fall back on industry standards, what Gallery has paid past trainers, or some other means of making her case. I believe I read that she has requested a jury trial, which would be wise as long as Gallery's counsel doesn't have anything to fire back at her. Borell is named as defendant in other lawsuits, but perhaps they relate to or were caused by her not getting paid (I'm speculating). I would think Gallery would look to settle this before going to court and gets ugly, but that may be presumptuous.
