In my view when the decision was made to let Modern Games run for purse money after being scratched, the horizontals should have immediately been declared an ALL payout.
It's really not that difficult. People would still be bitching (rightfully so) because what occurred was completely inexplicable, but at least in this action there is a hint of propriety and care for the bettors rather than the this ongoing CYA sh1tshow which is sadly unsurprising.
