Apparently so. I had the 2 in the 4th and got no refund.

I just went and looked it up. Should have known NOT to listen to TVG.
This is from Kee site on rules dated 3/25/08:

Pick 6:

1. 2. a. In the event of a late scratch after Pick 6 wagering has concluded, the bettor receives the actual post time favorite as evidenced by the amount wagered in the win pool at the time of the start of the race.
   3. b. In the unlikely event the condition of the turf course warrants a change in racing surface, see "c" above.

So yes it does go to favorite at Kee, there would have been no confusion without TVG.

When they put the P6 #'s up it said 2,3,7 for that leg.

They obviously gave the people with the 2 & 3 the favorite.

The problem lies with their website stating that after the wagering closes you get the favorite. So, I read that as any late scratches in the 4th race get you refunded and any late scratches in the 5th through 9th races gets you the post time favorite.

When the 2 & 3 scratched out of the 4th, the wagering was still open.

They and every other jurisdiction, just need to be crystal clear when they are posting scratch rules on their website. It's yet another thing that can turn off the casual fan. The different wagering rules from track to track and vagueness in their posted rules for wagering. It is low on the list of problems, but it is a problem.
