Actually Sotomayor broke her shoulder in a fall last week. She said it should not interfere in her job. I'm sure decision was made a ways back and opinions have been written by clerks and edited by justices. Whatever it is, it is by now.
Just waiting for the "Reveal". Would change the complexion of the US. Would take something that many of us did illegally in the US for most of our lives and make it legal. I, personally, think it will have little effect on Thoroughbred Racing, per se. Now it will have a big positive effect on tracks (Monmouth) who can capitalize on it. I don't think it takes handle away at all. I know people who play only horses, or horses and football, horses and basketball and only sports. The people who play horses are still going to play horses. If they turn it down, it will be a terrible blow. With the precedent of a SCOTUS judgment, it would be extremely difficult to ever approach it again. However, I think Nevada and Delaware throws a wrench into this. It creates an unfairness issue among states, that is why I think it goes through. I think they have to say it is OK for everybody or OK for nobody.
