Torre is smart. Suspend him for the 2 games in NY. Removes chance of some yahoo fans tossing crap from the stands at Utley and further inflaming situation.

No fourth out at all. What you saw was something that hasn't happened in some time. A play on the field that the rules couldn't account for because of the new replay rules. Replay showed that the umpire was in error calling the out as there was no tag of player or base. Umpire should in a perfect world have made no call at all. Then player either goes to the base realizing play is not over, or walks away and cedes the out. Instead he was called out and left the field as would be proper. Then umpire stops play and ball is dead.

Without replay the player is out as called. With replay now you have created a conundrum. Runner is neither out nor safe, but play has been stopped. There is nothing concrete now. Only judgement that can be made is that the runner would most likely have been safe if the correct call, or lack there of, was made. Not satisfying, but it is the most reasonable call that could have been made in the situation. It is thus the replay rule that will need most to be examined and updated in the case that replay shows runner neither out or safe when play stopped.
