The NYT is the one making the assertion. They want NYRA to prove a negative? The horse isn't injured til there's evidence of an actual injury. That's how it works. Chart callers are given the same deference as vets now? Industry standard matters in a court of law, apparently not to a newspaper. Jockeys pull horses up just to be on the safe side. We all know that happens sometimes. They just gave us the equivalent of "Yeah right, nice try. Prove it." Anecdotal evidence not good enough for ya? Enough of it from the right people works for a judge, but not for the NYT.

I think the NYT missed a chance to inflate numbers by counting made up, pre-race gossip about non-existent lameness as well as decisions to run in protective bandages. I'm a little disappointed in them.
