I agree, but legally she can't claim that she was being discriminated against. (It's only the racial discrimination part that was tossed; the allegations of sexual discrimination can still go forward.) From the ruling:
"While Plaintiff may have faced significant challenges in managing a workplace allegedly permeated with racial discrimination, her difficulties do not fall within the zone of interests sought to be protected by Title VII [of the Civil Rights Act of 1964] and cannot support a claim for racial discrimination under that stature."
I read the entire complaint, and there's still PLENTY in there to go forward.
Whether any of the black employees will decide to sue is the question- there's a statute of limitations issue, I think. But if you haven't read the NY Times piece about the woman who was Deen's head chef, I highly recommend.
