If he doesn't use the whip and gets nipped for second does he gets fined or investigated for not finishing out the race? If they really had any idea about horse racing and truely cared about these animals they would look into the drug use involved on the horses instead of searching for publicity.

Yeah, if they really wanted to do something then pushing for an autopsy that determines what sort of medications the horse was given would be a lot more effective than condemning the jockey and the use of a whip.
