A few thoughts and more importantly a few facts:
1) attorneys and judges who are members of the California bar have been interviewed and say that 45 day sentence is extreme for ANY defendant, usually in such cases, probation is continued or at most, a few days in jail (3-6). This judge has shown repeatedly that he's making an example of Ms Hilton.
2) The media continues to imply that her getting credit for 5 days is "unusual"...absolutely wrong! In the 10 years I worked in corrections in Pa, the law was clear...you are incarcerated on a day, you get credit for that day regardless of the time, same with discharge...you can be discharged at 12:01 am on discharge date. Hilton was admitted in the late evening and discharged early AM...she (or any other inmate) gets credit for those days.
3) She was apparently (according to reports) examined by a psychiatrist (not psychologist as CNN keeps saying) and found to be clinically depressed and close to a "nervous breakdown" (not a psych dx, apparently close to a psychotic break). Once documented...this put extreme pressure on authorities...forget it's Paris Hilton, is it worth risking severe psychological damage to an inmate over 18 days??? Think of the media response if something happened to her, think of the lawsuits and most importantly...think of the person!
3) CNN originally reported that she was a "no show" for court today...turns out it was a "pissing contest" between the Sherriff's Dept and the judge and only after the Dept caved in to the judge was a car sent to pick her up.
4) It is obvious that most of this is a power struggle between the Sherriff's Dept and the Judge...there was no testimony in court today about her medical condition, the judge was obviously upset at the sherriff's Dept and he slammed her again! This isn't justice prevailing, this is bare naked political powerplaying.
