Silks are registered to owners with the Jockey Club; no two owners may have the same silks (which doesn't stop some from being very similar).
If a horse is owned by two or more different registered owners, I think it is up to them to decide whose silks are used, although most times the majority (or plurality) owner gets the honor: but I don't think there is a rule about it. If the horse has a stud deal finished for the future, it usually carries the original owner's colors while it continues to race (like Secretariat racing in the Chenery colors, not Claiborne's). But again, it depends on the deal made.
