Just a curiosity, where there BC Future Bets made on this horse after the day he died? If there were, shouldn't Zayat be charged with fraud because of this? He had inside information, that his horse was dead. If this occurred in the stock market, he would have been in taken care already.

He might be a JO? A lot of folks lined their pockets selling him stock at ridiculous prices. I dont discount he might not be a great guy? He did THROW millions into the game at the top of the market and that has got to hurt.

Actually Fifth Third is one of the leading banks in racing. Many banks wont extend credit for something as risky and 5/3 has kept many racing/breeding operations afloat when times are bad.
Banks lend money and charge interest on it. Both parties have to agree to the deal. Banks treat the superrich differently from the average schmoe. Thy extend more credit and offer more generous terms so that when they superrich client will transfer more business to them once the immediate need for creit if past. Fifth Third was probably pretty sure that Zayat had a temporary need for extra cash and would be able to repay soon. It appears that not only was that not the case, he had chosen NOT to disclose a large insurance settlement that could have been used to offset debt. If it is determined that the value of Thorn Song was used as collateral for the loan it is all the more a problem as Zayat, by collateraizing the horse effectively made 5/3 a partner in the horse. You cannot destroy collateral and accept an insurance payment on it and then not inform the leander that it is gone.

Also, the JC rules say that owners are reuired to submit a death certificate to the JC if they have papers. Zayat didn't do so which begs a few more questions. Does he have the papers? Does Fifth Third Bank have them? Was he just trying to be sure that no record of the death was avaialble? Why?

Dude, cool your jets. I was speaking to hiding the death of the horse to hide the fact that he received insurance money. I hear what you are saying but I can't give him a pass just because he is in the business just like I don't give Tanaka or David H Brooks a pass because they were in the business.

What I will never get ... is how so many of these owners with so much money to start with always have a knack of finding the thieves who rob them blind.

It's easy for an exotic dancer to get money from you when its 3am and you are alone in the private lounge. I really don't enjoy strip clubs at all. To each his own, but I just don't get how they're enjoyable....Lounges/clubs sure, strip clubs----not so much.

i was hoping it would turn out an incorrect story, but thought the chances of that were nil.

they going to rename him lazarus, if in fact he's still alive? at this point i'd say someone needs to show the horse so we know for sure.
